一、服務說明 / Service Description
服務內容 Service Content
Orban 提供分散式 GPU 算力服務(Distributed GPU Compute Service),主要服務內容包括:
- AI 訓練與推論運算 AI Training & Inference
- 大數據處理與渲染 Big Data Processing & Rendering
- 按需分配彈性資源 On-demand Elastic Resources
- 分散式 GPU 算力租用 Distributed GPU Rental
禁止使用 Prohibited Use
為確保服務品質與合法性,以下行為嚴格禁止:
- 違法運算任務 Illegal computing tasks
- 惡意挖礦或濫用資源 Malicious mining or resource abuse
- 未授權網路攻擊 Unauthorized network attacks
- 侵犯智慧財產權 Intellectual property infringement
服務特性 Service Features
本服務採用「預儲值 + 後續持續扣款」的計費模式:
- 用戶需先預先儲值至帳戶 Pre-deposit required
- 系統根據實際使用量自動扣款(按秒計費)Auto-deduction based on actual usage
- 即時監控使用狀況與餘額 Real-time monitoring
- 支援自動補充餘額功能 Auto-refill support
二、儲值與計費 / Prepaid & Billing
2.1 計價貨幣 Currency
主要貨幣 Primary: 美元(USD)
支援貨幣 Supported: 台幣(TWD)
系統以 USD 為基準,台幣依當時匯率換算

2.2 儲值規則 Deposit Rules
- 最低金額 Minimum: $10 USD
- 有效期限 Validity: 儲值日起 12 個月 (12 months from deposit date)
- 自動扣款 Auto-deduction: 按實際使用量扣除(按秒計費)Charged by actual usage (per second)
- 不可轉讓 Non-transferable: 點數僅限帳戶本人使用,不可轉讓或兌現 Credits are personal and cannot be transferred or cashed out
2.3 支付方式 Payment Methods
- Visa / Mastercard / JCB 信用卡
- 銀聯卡 UnionPay
- American Express(需額外申請 Requires additional application)
- Apple Pay
2.4 儲值流程 Deposit Process
- 登入 Orban Platform Log in to platform
- 選擇儲值金額 Select deposit amount
- 選擇支付方式完成付款 Choose payment method and complete payment
- 系統自動入帳(5 分鐘內)Auto-credited within 5 minutes
- 收到電子郵件通知 Email notification received
2.5 餘額不足 Insufficient Balance
當餘額不足時 When balance is insufficient:
- 系統暫停任務並發送通知 System pauses tasks and sends notification
- 24 小時內儲值可恢復任務 Tasks can be resumed if recharged within 24 hours
- 超過 24 小時任務自動取消 Tasks automatically canceled after 24 hours
2.6 違規處理 Violation Handling
以下行為將導致停權並沒收餘額 Following actions will result in account suspension and balance forfeiture:
- 盜刷、詐欺、洗錢 Fraud, scam, money laundering
- 利用系統漏洞 Exploiting system vulnerabilities
- 買賣或交易帳戶 Buying/selling or trading accounts
- 將點數用於禁止用途 Using credits for prohibited purposes
三、計費方案 / Pricing Plans
收費模式 Billing Model
Orban 採用「按使用量計費(Pay-as-you-go)」模式,依據實際執行的任務(job)數量收費:

最低儲值金額 Minimum Deposit: $10 USD
自動扣款 Auto-deduction: 系統依實際使用量從預儲值帳戶自動扣除 Auto-deducted based on actual usage
彈性計價 Dynamic Pricing: 根據任務複雜度、GPU 型號與執行時間動態計算 Calculated based on task complexity, GPU model, and execution time

四、退款政策 / Refund Policy
4.1 不予退款 No Refunds
所有儲值與雲端運算服務一經購買即為最終銷售。付款完成後,除法律明確要求或平台無法提供服務的情況外,Orban 不提供任何形式的退款或費用返還。
All prepaid credits and cloud computing services are final sales. Once payment is made, no refunds will be provided, except where explicitly required by law or in cases where Orban is unable to provide the service. Due to the on-demand nature of the service, system resources are allocated immediately upon purchase and cannot be reclaimed.
4.2 SLA 補償 SLA Compensation
若 Orban 未達到服務等級協議(SLA)所規定的可用性標準,客戶有權要求延長服務時間或額外資源作為補償,而非退款。具體補償方案將依照 Orban 的補償政策執行。
If Orban fails to meet the availability standards outlined in the Service Level Agreement (SLA), customers are entitled to request an extension of service time or additional resources as compensation, instead of a refund. The exact compensation will be subject to Orban's compensation policy.
4.3 客戶責任 Customer Responsibility
客戶需自行管理雲端資源的使用。Orban 對因客戶操作錯誤或管理不當造成的損失不承擔責任,且不會因此提供退款。
Customers are responsible for managing their use of cloud resources. Orban is not liable for any losses caused by customer error or mismanagement, and no refunds will be issued for such cases.
4.4 法定退款權利 Statutory Refund Rights
本退款政策不限制或排除您依據適用法律(包括歐盟消費者權利指令、台灣消費者保護法等)可能享有的任何強制性法定權利。
Nothing in this refund policy limits or excludes any mandatory statutory rights you may have as a consumer under applicable law, including the EU Consumer Rights Directive and Taiwan Consumer Protection Act.
五、服務品質 / Service Quality
5.1 可用性目標 Availability Target
- Personal: ≥ 95%
- Academic: ≥ 98%
- Enterprise: ≥ 99.5%
5.2 補償機制 Compensation Mechanism
當服務可用性未達標準時,Orban 將提供算力點數補償。補償金額將根據實際可用性與服務方案等級而定,補償點數有效期為 6 個月。
When service availability does not meet the standard, Orban will provide compensation in computing credits. The compensation amount will be determined based on actual availability and service plan level. Compensation credits are valid for 6 months.
5.3 重大事件補償 Critical Incident Compensation
針對以下重大事件,Orban 將提供相應補償:
For the following critical incidents, Orban will provide appropriate compensation:
- 資料遺失無法恢復 Unrecoverable data loss
- 資安漏洞導致外洩 Security breach
- 連續服務中斷超過 24 小時 Service outage exceeding 24 hours

請於事件發生後 30 天內聯繫客服,我們將根據實際情況評估並提供補償。
Please contact customer service within 30 days of incident. We will evaluate the situation and provide appropriate compensation.

六、帳戶安全 / Account Security
6.1 用戶責任 User Responsibility
妥善保管 Keep secure:
- 帳戶密碼 Account password
- API 金鑰 API keys
- 雙因素驗證裝置 Two-factor authentication device
6.2 異常監控 Anomaly Monitoring
以下情況將通知並可能凍結帳戶 Following situations will trigger notification and possible account freeze:
- 異地登入 Login from unusual location
- 大量 API 呼叫 Excessive API calls
- 異常儲值或消費 Unusual deposit or spending patterns
6.3 資料保護 Data Protection
- 遵循 GDPR 與台灣個資法 Compliant with GDPR and Taiwan PDPA
- 用戶資料不提供第三方 User data not shared with third parties

6.4 帳戶關閉 Account Closure
- 可隨時申請關閉 Can request closure anytime
- 餘額保留 30 天供領回 Balance held for 30 days
- 30 天後永久刪除(交易紀錄依法保留 5 年)
Permanently deleted after 30 days (transaction records kept for 5 years as required by law)
七、智慧財產權 / Intellectual Property
7.1 平台權利 Platform Rights
Orban 軟體、商標等智慧財產權歸球球科技所有。用戶取得有限使用授權。
All intellectual property rights of Orban software and trademarks belong to Ball Technology. Users receive limited usage license.
7.2 用戶資料 User Data
用戶上傳或生成之資料所有權歸用戶,Orban 僅在服務範圍內使用。
Ownership of user-uploaded or generated data belongs to users. Orban uses it only within service scope.
7.3 禁止侵權 Infringement Prohibition
不得利用服務 Prohibited to use service for:
- 訓練侵權 AI 模型 Training infringing AI models
- 處理侵犯隱私內容 Processing privacy-violating content
- 使用盜版軟體 Using pirated software
八、條款變更 / Terms Modification
8.1 變更通知 Change Notification
重大變更提前 30 天通知 Major changes notified 30 days in advance via:
- 電子郵件 Email
- 平台公告 Platform announcement
- 版本紀錄頁面 Version history page
8.2 用戶同意 User Consent
繼續使用服務視為同意新條款。不同意可於生效前關閉帳戶並退款。
Continued use implies consent to new terms. May close account and request refund before effective date if disagree.

Invalidity of any provision does not affect others - 語言 Language: 繁體中文版為主,英文版供參考
